In the US we have a thing called the 4th Amendment that protects us from illegal searches and seizures.
In every state (I think) the cops have the right to order the driver out of the car during a routine traffic stop.
In most states (I know NJ is an exception) they can order the passengers out of the car as well.
They cannot search the vehicle without probable cause.
they can search anything that is in plain sight.
They need to get your permission to open the trunk. They can hold you until the drug sniffing dogs arrive.
This was a border patrol. Border patrols do have the right to search your car.
I think ccnoob is right that this guy is an activist who was looking for standing to bring a lawsuit. Thanks to the gash in his head and the rough treatment he now has that standing.

One of the problems with stuff like this is that it is hard to make a determination because I don't have all of the facts.
I would like to see tougher 4th amendment protections imposed upon the police. The police regularly abuse the power to stop and frisk, search in plain sight, etc. One of the biggest problems is usually profiling.
Having said that, this was a border patrol (albeit one that was far from any real international border) and we all know we can get searched at the border.

Would have been "nice" if they gave him one more warning explaining he would be forcefully removed.
I hope these officers checked with a supervisor, or at least know what they can or can't do. I wonder what will become of the whole thing.
