Negative, you Will be arrested.....not, you MAY be arrested.

Don't want no trouble?

Don't start no trouble !
"Acting up" does not justify taser use. They are to be used in self-defense or if absolutely necessary to effectuate an arrest. The PERF guidelines specifically say they shouldn't be used against elderly persons.

Is any of this getting through?

EDIT: Before the bump/shove after the profanity she then says "Give me the ticket and I'll sign it".

I'll take that as a "no".

I googled but I can't find anything saying Texas is an exception to the rule that an arrest is discretionary IF the person doesn't sign the traffic citation. Your assertion otherwise (which may be correct) requires some supporting evidence other than your say so.

Nor do I hear the officer say "You're under arrest" rather he repeatedly says "Step back or you're going to be tasered".

The United States has the right of Freedom of Speech. She can call it a #$%^&*()citation if she wants too. Bumping up against the cop? Are you kidding he shoved her. Standing your ground is a natural reaction when you are shoved. Cops arrest guys all the time for shoving women.

I bet you a more civil officer could have got her to sign the citation with little or no trouble. Didn't you ever watch Andy Griffith? You sound like Barny Fife.

I agree!

It is pretty sad when a man that size can't control a little senior lady, without having to push her and taser her. They have to take the taser guns away from the bullies.

I couldn't actually find it in a law book but this is what these people say. Still, an officer can use common sense and send granny home safe. There is not a no tolerance clause in Texas law.

An officer of The Law is required to serve and protect his employer, which is The Gov't, Not any individual. The Law says that you can't use profanity towards an officer of the Law and you are required to obey the officers Legal orders. Now, he may have broken granny's arm trying to arrest her, or he could give her a 5 second jolt to bring her to her senses. She could have simple said she had no brakes and was in a hurry to get home before she had an accident to wit. I always sign.

It was part of her list of 50 things to do before you hit 75.

47. Swear at policeman
48. Get tasered
49. Get on youtube
50. Get a thread on Red Hot Pawn

She can now die happy 😛

Yes, that's the article i read. It said "MUST" sign the citation. Signing is Not an admission of guilt. What's the big deal? At what age does Elderly begin? Does the officer have to guess her weight also? Has the law become a side show now. The officer pushed her to keep her from running out into traffic where she could have been killed...to wit.

No s**t. Read the post.

Swearing at an officer does not give him the legal power to use force against you.

I don't know how it is in your country but in the United States the government is 'we the People', meaning all of us. Protecting his employer is not the duty of the police against the people, That is not what the police is about. Police arrest Police all the time as they should. Not as much as they should, but they can and will. You are wrong.

This is a silly debate. The officer over reacted.

Do you really believe that? If so, you're badly mistaken.
