MJ was acquitted the second time. The first time there was a settlement.

Legalese and the rich can say what they want, but settlements are made because the offender has his boys in a vice. If you're innocent you prove it in court. I don't think MJ was innocent. I don't think Kobe was innocent. They settled because they had to.

I've been involved in two settlements and the damage awards went to me. I was the victim. Those who had to settle with me can say there is 'no admission of guilt', same as MJ and Kobe, but that's a load of crap. It was crap in my cases, it was crap with Kobe, and it was crap with Michael Jackson.

Sorry to hear about your trouble, but you or I were not there, and we truely do not know.

We both can assume, and that is about all we can actually do.

MJ was quite childlike himself in so many ways. I think he could very easily be taken advantage of himself.

coincidentally enough, about half an hour ago i was reading a newspaper article about the pharmaceutical company Merck, and how it had settled US litigation against it over its anti-arthritis drug Vioxx. seems one difference between the US and the rest of the world is that in the US, compensation payouts are awarded by juries in civil cases.

Merck claims it settled in the US because of this, and plans to fight litigation in all other jurisdictions, including here (Australia)

I guess the implication is that you might settle in the US, not because guilt can be shown, but because you believe the jury will award a large payout against you.

That's not the practice here with large corporations. They have their little army of lawyers that they pay anyway, so why not fight tooth-and-nail over each and every claim, regardless of its merit? That's the practice. And if that fails, then appeal. Or if you didn't like the damage amount, appeal. Or hell, you're paying these lawyers anyway - appeal just to appeal. That's what they do, even when a case is clearly 100% not in their favor. I speak from personal experience on this topic.

There were huge problems with Vioxx. That's why Merck settled.

I don't have to be there. I can use a logical inference. I can use analogous situations. I'm not 'assuming' in a vacuum. Jackson had a ton of money, so why not fight a bogus accusation?

One does not settle in excess of 20 million because they're innocent and just want to move on. You may feel ok treading on ambiguous hear no evil, speak no evil, see no evil ground but I won't. I'm just calling it as I see it, and even if it's a case of nothing happened except MJ was caught in a compromising position then it's his own fault for being such a dumb$#*@.
