Presuming that the n00b in question lives in a jurisdiction that has adopted the internet predator law and that the person making the statement was 18 or over then the statement constitutes a criminal act punishable by fines and/or imprisonment.

In a recent lawsuit involving the rape of a 13 year old girl, the lower court dismissed a civil action against myspace that alleged in part that "myspace.com has created a sexual playground for child predators," on the grounds that myspace has no affirmative duty to verify the age of participants on the site.
I think it is up to the community and the individuals on this site to police themselves. I think we just need to keep this issue out there and remind people that while we all want to have fun, certain behaviour is not appropriate.
