Isn't a defendent responsible for his own defense? Would the prisoner obtain an Afgan lawyer to aid in his defense? Or would the UN appoint one? Sounds like this could take a long time.
When one is a prisoner of war other rules apply until the combat is over. In Afghanistan the war "ended" with the over-throwing of the Taliban and the installment of the new government. In Iraq it ended with the installment of their new government. Sure as church bells sound sweet on a lovely Spring Sunday morning, I remember young president Bush even saying as much.
