Think about the reason you are probably on death row.
You are saying they would be killing you, then again you probably on death row for killing someone else. So you get to kill them for killing you surely they get to kill you for killing someone else?
a. I'd be innocent
b. I felt justified in having killed whoever I killed.
Equally, if I must suffer for my deeds by having the same done to me, then it is justified for me to wish those exact same deeds done to the people doing them to me.

i propose a deaf penalty: if someone commits a heinous crime, they have hot wax poured in their ears. then no one else needs lose a life.
apart from the person with hot wax inside their heads.
But more so that 100% proof is never possible and mistakes do tend to happen.

Well, it depends on whether you want to be remembered or not. Remembered as the whiny little arse one are, or not remembered at all. Surely, no one will remember the one (rightfully convicted) man who didn't say a word.
Just the same, I'd probably just take it like a man and give those whom I feel are treating me injustly the finger. To die, knowing you annoy the hell out of those whom whish you harm is a good way to die. (Me thinks.)

But more so that 100% proof is never possible and mistakes do tend to happen.
Get rid of death penalties all over the world and use the labour force appropriately. We all know, that really, really smart criminals aren't ever caught, so to sentence someone to death is premeditated murder since we can reasonably assume that, because the person were caught, (s)he's not in fact the real killer.

Although, one could say that the prisoners aren't exactly slaves if put to work. It is assumed, that if a legal court has judged them, they are guilty of a crime and should be punished both to set them straight and to warn off other criminals-to-be, right?
So, putting them to work (within humane working hours) is a good punishment. Everyone hates work. And any criminal will want to avoid it at all cost. So, it stands to reason, that by putting convicts into work for society, everyone is served right and everything is just. You can hardly call it slavery (even though I did) since they will get their own quarters, free meals, good communication possibilities with the surrounding world via Internet and Television, specially designated rooms for practising intercourse and a lot more. Though, they will have to work, which of course is the deterrent factor to all this.
(In Sweden there's a standing joke about this. We actually, literally, treat our elderly worse than our convicted criminals. The elderly are forced to go to bed at 5 or 6 p.m all year round, they're only allowed to go outside when it suites the staff, they're given food that you wouldn't eat unless somebody pushes it down your throat and I can go on. Really, it's true. In swedish prisons, it's more of a hotel if you think about it. So, over here, the deturrent factor is growing old. We don't worry much about death penalty. That would actually be a good thing for those who are becoming of age.)

Instead, why not put the almost guilty in cases and pee on them? That way, at least they can get out of the cases and wash up after we've released our mighty flow of justice.
What of the crimes? How can we prove a woman was raped? A home was burgled? A person was killed? Since we don't know anything 'fer shure,' let's just give up on the whole justice proposition, and I'll be first in line to replenish my now-growing aresenal.
