Anyone ever been in the military will tell you about seeing people standing at attention for too long and keeling over....fainting for a variety of reasons is not uncommon.
The bottom line on the medical investigation was this:
"He later testified to feeling sudden mountain sickness — a finding supported by a neurologist’s June 2021 diagnosis"
Then the japanese judge threw it out.
Because he was like, medically more qualified than the physician's opinion.

Believe it or not, American courts don't automatically accept claims by criminal defendants even if they get a medical opinion to support it.

Japanese judges are notoriously prejudiced against non-japanese defendants.
If he was black I bet you'd all be defending him and crying about the court being racist, etc.
The unforgivable thing is the DoD cancelling his pay and leaving his wife and children out in the cold.
With all the trillions Biden and the Dems are throwing away they cancel a young Navy Lieutenant's pay to his family?

The supposed prejudice against White people argument right wing nuts make is noted. That is really the whole point of this thread as shown by the OP. That it is racist BS makes it consistent with 90% of your postings.
US military regs say pay is suspended when a member of the service is incarcerated for more than six months. Sen. Lee pointed to a statute regarding those absent without leave which is inapplicable to the present case. If Congress wants to change the regulation it can do so, but the change should effect all service members in prison not just this one.

It was published before Alkonis' appeal was rejected by a higher court. An excerpt:
"English-language court records obtained by the AP show that the judge expressed skepticism over the mountain sickness clai ...[text shortened]... was difficult to imagine he went from not feeling drowsy at all to becoming suddenly incapacitated."
If he, as he said, started to feel drowsy did he not have an obligation to pullover rather than just plowing on, he’s not evil but I think he’s culpable in the deaths of two people.

Japan is well known for a 99% conviction rate. You never want to go to trial in Japan.
Perhaps they do not go to trial without a very solid chance of conviction plus they have a very liberal penal system so perhaps more defendant’s plead guilty.
Politics could come into play in some parts of Japan where the presence of the US military is resented at the local level. But if this guy was a sacrificial lamb I’m sure the navy would take that into account.

You just don’t think any white Persian should be in prison for killing a non white person, I feel for his family and the navy should support them during his incarceration but he can do his time.
