Okay, I think it's criminal, because she was drunk and emotional and wanted to kill herself, so I believe that the prosecution can argue a case of diminished capacity, i.e. wouldn't have been able to kill herself if not for him helping her. It's also very rare for wo d that they should have go through a judge to get permission, i.e. legalised euthanasia.
But everything applies to him too. He was drunk. He was emotional. Why assume she was with diminished capacity but not him? Why shift criminal responsibility to him when she was the one to pull the trigger. I'm not convinced...
