Had she brought out a personal alarm, sounded it in his ear and caused him permanent deafness should she be charged or is she just defending herself?
She needs to take responsibility for any action taken. Hell, if her rape whistle had caused ear damage then she needs to get punished appropriately, just like the drunk douchebag needs to get a couple hundred hours community service.
