Of course it is. Stores also have the right not to sell it and people also have te right to protest it.
There is no legal recourse to them selling it. The only way to keep it from being sold is if the public makes a big enough outcry, the stores won't sell it and the distributor/manufacturer pulls it for fear of backlash on to other products they carry.
A good example of this was Body Count's "Cop Killer". Perfectly legal for them to produce the album and sell it. But, it was only on the shelves a few days before the protests got really big. The music label pulled the album for fear of an across-the-board boycott of all albums they produced.

I think it is absolutely disgraceful and I seriously shook my head in absolute disgust when I heard about this game. It is sickening and I cannot believe that this idea was actually approved by the many, many people who have to approve these video-game ideas.
