There are two different kinds of moderators, actually.
One is a Forum Moderator, who basically polices here in the Forums, responding to alerted posts, etc.
Then there are the Game Moderators, who investigate games in question.
This is my interpretation and your questions are good ones. However, I believe that the Final Word comes from RUSS with regards to cheaters, banning, etc. with input from the Mods.

i could only agree with the idea of a moderator, or an official for that matter.
we are here wasting hours of our life because of our passion for chess. like it or not, it's an emotional investement. and it's pointless to have people abusing everybody's good faith.
nevertheless, the rules should be clear to everyone. and written down.

The moderators will have to present to Russ overwelming evidence of engine use in a series of games. One game in unlikely to provide sufficient evidence.
If they are smart, the exact criteria used by the moderators will remain secret. It would be self-defeating to inform potential cheats exactly how they are going to get caught...

The TOS says you can't use an engine to play your moves. If you don't use an engine to play your moves, the chances of you matching an engine move after move, game after games is statistically impossible. So relax.... unless, of course, you ARE using an engine, in which case... ðŸ˜
So, if in the considered opinion of the game moderators you are using an engine, and if Russ concurs, there is very little you can do. You won't be arrested, imprisoned, or lethally injected. The worst that will happen is that you will have to play your chess elsewhere.

South Africa is where I now live. I was born in Wallasey, Merseyside, UK. And FYI, South Africa also has a long and more recent history of fighting for democracy - something we Brits have not had to do for hundreds of years.

While "exact criteria" need not be specified, I've stated before that accused players should be confronted with the evidence against them and given a chance to defend themselves. This to me is only simple fairness. While it's true the consequences of a finding are "merely" a banishing from the site, many here would find that a certainly unpleasant result. I would also prefer if some guidelines as to what evidence will be considered by the Game Mods in their determinations be publicized; after all, we have been told to report cheating accusations via feedback - it is only reasonable that we have some idea as to what we should report (Russ did ask us to be precise). Therefore, I hope the Game Mods will put together a rough outline of what they will consider persuasive evidence so that we can all be confident that the goal of reducing engine use here is being rigorously pursued, but that the non-cheating player has nothing to fear.
