No reason to blame a chess player. It is the system that leads to this confusion.
Chess players should not given the power to decide when they have to apply the TO. It can easily lead to confusion, anger and mud throwing.
An automatic TO will solve this problem.
RHP could also automatically send a reminder 24 hours before the TO-flag falls.
Automatic TO also would help to change the profiles of chess players. Half of the space there seems to be filled with how people deal with TO's.

Just an idea - maybe an option in the menu when you create the game that states that TO's will be automatic, which will be known by both players before the start, would help people know where they stand?
Another idea - it was mentioned before the ratings graph of each player could be modified to show if the win/loss was by TO. If the bar for a game was blue for a TO victory and orange for a TO loss then we could see at a glance if a persons rating had dropped due to mass TO's. We could also see if the players preference was to claim TO's, and at least be aware that they might TO if we are late moving.
Let's not forget we now have the <time bank> feature to prevent any trouble in connection with time out problems.
Let's wait and see how this feature will work in practise.
Besides that, if you want to cause trouble you certainly will find a way, with or without time out issues. There always will be trouble of some sort. It usually does not depend on the rules .....
