Most people don't think of the word retarded as offensive, especially when used like this, not in a negative way. If you think that was insulting, I suppose the only valid use of retard is to mean slowing something down. He just meant stupid questions. Don't be so touchy he was not trying to insult your brother. It's a fairly common usage of the word where I was and I have never meant anyone who found the usage of the word in that context to be offensive. It would be understandable if he was calling your brother a "retard" but he wasn't. Sorry if it hurts your feelings but someone takes offense at almost everything anyway.
