Having 2 accounts, in this case, is very minor. I remember a 2300 player being banned for such a violation previously.
The action of playing 2 accounts owned by the same person against each other is in a single word: CHEATING
Which makes the perp a CHEATER !
Which, apparently, is NOT a violation of the ToS.
(And then there is the OTHER issue still not resolved)
