technically, that's a homonym (same name), which is both a homophone (same sound) and a homograph (same shape).
I believe the intention here is homophones that are not homographs.
Any homophones were allowed including those which are also homographs however
it seems more fun (and challenging for the setter) if we stick to non homographs.
