You can't patent the idea, as there isn't a physical end product that can be infringed upon.
To be able to copyright this pattern is unlikely too, as it is highly likely that in recent times somebody has used 53 dots in a row on a pc. If they did it first, and can prove it, then the copyright belongs to them. Unfortunately, for you, we believe we would be inundated with copies of e-mails claiming copyright, from as far back as 1982. My copyright representative sends his condolances.
