If I could proove to you that Kirksey is black in real life would you care about the things he says?

What you need to understand is that Kirk is black on Red Hot Pawn forums...whether or not he is black in his real life is not necessary to know, and certainly not your business.
Well, it kind of is his business. As an appointed moderator it is very much his business.

TOS

Member conduct

Impersonate any person or entity, including, but not limited to, RHP staff, or falsely state or otherwise misrepresent your affiliation with a person or entity

It is up to him and the administrators to decide if the boundaries have been crossed. Trust me when I tell you, it doesn't take much, the bass ard. 😉

Okay...

Phlab, is it a violation of the TOS to pretend to be a certain race on the forums when you are, in fact, a different race in real life?

I'm mentally handicapped, but Dr Scribbird believes Kirksey is Black. Makes a lot of sense.

When you look at Kirksey, all you see is his skin.

I know the real man behind the skin, and he's as black as God makes 'em.

If it is a violation, then do I have to stop pretending to be a polar bear?

There is a surreal quality to this thread and discussion.

Are you insinuating that he may not really be a purple penguinpuffin? 😲 But I have seen the pictures from the London Meetup!

However, in your case, I'm just not prepared to accept the pirate clown thing.
