This issue seems to be the crux of the case -

Observers and reporters of the trial pointed out that the real reason the Watchtower lost the case and may find appeals expensive and fruitless, is because it set very clear policies on how to treat known pedophiles and other criminals within a Kingdom Hall. Board of Elder letters issued by the Watchtower clearly instructed the elders in charge NOT TO REPORT alleged crimes to the local police immediately (in spite of state laws requiring such reports), but rather to call the Watchtower’s Legal Department first for instructions on how to proceed. The Watchtower further complicated their defense by instructing elders NOT TO WARN OTHER MEMBERS that a known molester was in their midst and that they should take steps to protect their children and restrict access to such persons.

at the moment,

Lawyers for WTBTS

In this case, Ms. Conti and her lawyers are suing the Fremont Congregation for
negligence. But I think the evidence will show that no one in the congregation, no elder,
no member, no one, saw Mr. Kendrick ever act inappropriately with Ms. Conti. Not only
did no member see it, but Ms. Conti's own parents did not see anything inappropriate.
The evidence will show that as Mr Simons as pointed out, Ms. Conti dd not tell
anyone in the congregation about the abuse until twelve years after it had stopped.

The elders instructed them (the M'Kendricks) in the case of Andrea, the very next day to
go to the police to and they didn't, so that makes the elders reprehensible, flip sake,
the more of this case I read, the more I am utterly astounded, its unbelievable.

It's shocking that an religious organisation claming to be the sole source of God's truth on earth could behave this way.

Or maybe its not that shocking...

If you read the court transcript you will see that at the outset, the lawyers for the
WTBTS, state that Mkendrick is and I quote, 'the villain', not the congregation of
Johavhs witnesses, do yourself and me a favour and read it for yourself, then you will
not need to ask such thoroughly silly questions in future. Once again , yawn, i am not
contesting that abuse took place, I am not contesting that McKendrick was guilty of
abuse, I am contesting that the congregation was complicit in allowing that abuse to
happen, when in fact, they knew absolutely nothing.

behave what way, the congregation did nothing wrong. When the elders found out
about M'ckedricks abuse of his step daughter they told the family to go to the police.
But i suppose gullible minds will believe anything, especially from a known hate site,

No one is talking about the wider JW "congregation" - the is about the JW convicted of child molesting, the policies which you say are being held to blame and the leadership's decision to withold information about a convicted child molester - see PK's post at the top of this page. It's a sorry sordid affair to be sure.

No it isnt, that is where you are wrong, if you read the court transcript, there are
separate actions, one against the perpetrator Kendrick for abuse which I am not
contesting and one against the congregation of Jehovahs witnesses on the basis of
negligence which I am, that is what it is about, look, do yourself and me a favour and
read the court transcripts, her own parents contradict her claims.
