Imagine this: Some crazy pants would have sex with your mother's corpse... How would you feel? How would anybody that knew your mother feel?
I'm hoping you are just making this question for the sake of argument.
Therapy and a fine? Definitely.
Incarceration? WAY too harsh.

This stuff happens?! This is just how you see it? I see it as disrespecting a person and the memory we have of her.
It's not rape. He didn't hurt nor meant to hurt ANYBODY. So you think that in order to be rape the person must be alive? Do you think that many people won't mind having their body molested after they are dead. I know I do. Even if the person in question while alive didn't mind that happening to her once she was dead I must say they both need help. The part that he didn't meant to hurt nobody is problematic too. What about the relatives of the person. I think that any reasonable person would guess that they'd be hurt.

As someone who no longer lives, you have no rights. I certainly won't care what happens to me when I'm dead because I'M DEAD! Stop being so vain. You're not important.

I'm not saying that the person shouldn't be punished at all. I just think imprisonment is far too harsh unless that person is found to be psychotic in which case he should probably be institutionalized.
