Your HUGE problem is you think states should be able to over ride fed law.
That was your FIRST mistake.
Go back to 1890. The trains at the time had really dangerous car connectors, people lost their hands hooking up trains.
Feds stepped in, mandated an engineering change in those connectors which eliminated the possibility of hands getting ripped off.
1893 the law went into effect.
I think it was a Presidential executive order but the ultrarightwingnuts of the day screamed to high heaven 'you can't do that'.
It turns out YES HE CAN.
