@averagejoe1 saidIf a person is charged with homicide, it might turn out that the evidence is not sufficient to prove first degree murder, depending on what the defendant’s legal team comes up with (alibis or whatever); but the prosecution can still bring that charge to the proceedings if they believe they have sufficient evidence. In the Trump case, the DA’s office evidently did convince the grand jury that there is sufficient evidence to bring a felony charge. Whether that charge sticks, the trial will determine.
Then you are tryin it here?
Geez. You know all the facts which bump it to a felony ? Then since it hasn’t, why are you such a weenie, to not tell us that presently it is a misdemeanor? Why the word games marauder. It gets quite boring.
You are embarrassing. You say here that the proof will happen in the trial? So since proof that it is a felony happens after the t ...[text shortened]... lawyer will not say that.
Why not, Marauder? Why, I think we have a new issue here. Why not?
@averagejoe1 saidWhy don't you just admit you are totally ignorant of the workings of the US legal system?

The DA presented evidence to the grand jury which found that evidence sufficient to charge him with 34 counts of Falsifying Business Records in the First Degree. That is a Class E Felony in New York so why you keep clinging to the idea that Trump is only charged with a misdemeanor is a mystery to me.
@averagejoe1 saidThat is not a sentence.
Then you are tryin it here?
Time to knock off the booze again, joe.
@no1marauder saidtell us what makes this a felony, what is charged that makes it a felony?

We know dont we...bragg is trying to use a federal election interference law to make this a felony. he has no jurisdiction, that is why he wont state it.
Just call it what it is, bragg is interfering in the 2024 election
@no1marauder saidwhat action makes it 1st degree, that is what bragg has left out
Falsifying Business Records in the First Degree a Class E felony in NY.
How many times do you need to be told this?
@moonbus saidA liberal NY jury, they would indict their grandmother if it meant them getting their way

@mott-the-hoople saidThere's several possible crimes he could use as a predicate for raising the Falsifying Business Records from 2nd Degree to First Degree, none of which he is required to state in the indictment as your own NYT source conceded. The defense, assuming they are semi-competent, will surely request more specificity in a request for a Bill of Particulars.

I suspect Bragg will use several alternate theories, but the statute itself merely says "crime" so a strict reading of it would not preclude the predicate crime from being a Federal one.

Is a Federal crime "another crime" or not?
@no1marauder saidnot under NY law, where bragg has jurisdiction

@mott-the-hoople saidMott don't scare Marauder off, he has gone from the tango to the waltz, and it is fun to watch, We have been asking one simple question for two weeks and he has typed TOMES without answering the question . He says we are idiots, when all over the news the pundits are asking the same question. He dares then call all the pundits idiots!!!
The proper authorities have previously stated Trump did not violate any election laws...try again
Don't scare him off.
@AverageJoe1. I am no good at copy post paste algo thorns as are the libs, but I will try this.....to enlighten everyone about what Marauder avoids.

Please read just the first 4 pargraphs to understand what we have been hammering on Marauder, who is in denial. It's is fun to read.
Bragg turns one count into 34, because the 'count' happened 34 times, each time a check was written. Oh, Mr Seal Face Bragg, how cool is that, but, uhhhhhh, a bit obvious about persecution . Why, Bragg is More than a hyena, worse that you guys...almost .
@mott-the-hoople saidBragg has jurisdiction over the falsification of records in NY. By the clear wording of the statute, another crime is all that is required to rise it from a misdemeanor to a felony.
not under NY law, where bragg has jurisdiction
@mott-the-hoople saidNo authority has found so and Cohen pled guilty to a violation of the Federal election laws done at Trump's behest (Trump even admitted he made the payments to Cohen).
